King Faisal FC’s Appeal Dismissed by the Court of Arbitration for Sport

In a significant development for the Ghanaian football community, the Court of Arbitration for Sport (CAS) has ruled against King Faisal FC in their appeal against the decision of the Appeals Committee of the Ghana Football Association (GFA).

The decision was announced on Friday, October 27, 2023, leaving both parties with a resolution to consider.

The case at the center of the dispute pitted King Faisal FC against Tamale City FC, and the Appeals Committee of the GFA had already made its decision. CAS, in its judgment, upheld the decision of the GFA’s Appeals Committee, confirming its stance in the case.

However, the implications of this judgment go beyond the game itself. The CAS ruling determined that the costs of arbitration would be entirely shouldered by King Faisal FC.

This decision placed a financial burden on the club, as they had already paid a fee of CHF45,000 to CAS at the initiation of the case. Furthermore, King Faisal FC was ordered to pay the GFA a total of CHF 4,000 (four thousand Swiss Francs) as a contribution toward the GFA’s legal fees and other expenses associated with the arbitration proceedings.

The legal representation at the arbitration proceedings was notable, with the GFA being represented by Naa Odofoley Nortey (Esq), along with support from General Secretary Prosper Harrison Addo (Esq). On the other side, King Faisal FC was represented by Lawyer John Kwame Quayson.

The consequences of this ruling are substantial, particularly for King Faisal FC. The club is currently competing in the Division One League Zone 2 after facing relegation following the 2022/23 Ghana Premier League season.

With the financial penalties and the upheld decision, the club now faces both financial and sporting challenges.

This CAS judgment serves as a reminder of the importance of compliance with regulations and adherence to the rules of sports governing bodies.

It also highlights the role of legal mechanisms in resolving disputes within the world of sports, demonstrating that the decisions of such bodies are legally binding and carry significant consequences for those involved.
